These Terms of Service (“Terms”) govern the services provided by Live Treasure Network (“LTN,” “we,” “us,” or “our”). By engaging our services, accessing our website, or entering into a Seller Agreement, you agree to these Terms.
1. Nature of Services
Live Treasure Network operates as a commission-based sales facilitator. We assist clients in documenting, presenting, marketing, and facilitating the sale of personal property through live selling platforms and/or online marketplaces.
LTN does not:
• Guarantee specific sale prices• Guarantee that any item will sell• Provide legal, tax, or financial advice• Act as a certified appraiser unless explicitly agreed in writing
Final sale prices are determined by real-time market demand and bidding behavior.
2. Authorization & Legal Authority
By engaging our services, you represent and warrant that:
• You are the lawful owner of the items; OR• You are a legally authorized representative (trustee, executor, agent, or authorized family member);• You have authority to permit entry, documentation, recording, and sale of the items.
LTN reserves the right to request documentation verifying authority when appropriate.
3. Item Eligibility & Acceptance
LTN retains sole discretion to determine which items are suitable for listing or live presentation based on:
• Market demand• Item condition• Authenticity concerns• Platform restrictions• Legal or regulatory considerations
We reserve the right to decline, remove, or discontinue listing of any item at any time.
4. Client Representations & Disclosures
Client represents and warrants that:• All items submitted for sale are legally owned and free of undisclosed liens, claims, or disputes.• All known defects, restorations, authenticity issues, or material facts have been fully disclosed prior to sale.• Items do not violate intellectual property rights or applicable laws.LTN is not responsible for undisclosed defects or misrepresentations provided by the client.
5. Commission & Payment Terms
LTN operates on a commission-based model. Specific commission rates, payment schedules, and settlement procedures are defined in the signed Seller Agreement.Settlement payments are issued after:• Platform confirmation of completed transaction• Buyer payment clearance• Applicable return windows (if any)• Deduction of agreed commission and authorized expenses
LTN does not guarantee timing of third-party platform payout processing.
6. Recording, Media & Public Presentation
Client acknowledges that:• Photography, videography, and livestream recording are integral to the sales process.• Content of items designated for sale may be publicly displayed through livestream, listing pages, social media clips, or replay archives for the purpose of facilitating sale.LTN will make commercially reasonable efforts to avoid capturing unrelated personal or sensitive household materials.Client may designate “no-record” areas prior to filming; however, excessive restrictions may impact sale effectiveness.
7. Technical Requirements & Connectivity
Successful live selling depends on adequate technical conditions at the property, including stable internet access, sufficient bandwidth, cellular signal availability (if used), electrical access, and safe workspace conditions.Client acknowledges and agrees that:• LTN does not guarantee uninterrupted livestream performance.• Internet instability, Wi-Fi limitations, cellular dead zones, platform outages, or power interruptions are outside LTN’s control.• Audio/video disruptions, latency, or temporary broadcast interruptions may occur.If technical limitations materially impair the live event:• LTN may pause, modify, reschedule, or relocate the sale at its reasonable discretion.• A mutually agreed alternative date may be scheduled based on availability.• LTN shall not be liable for reduced bidding activity, perceived value impact, or delayed results caused by connectivity limitations beyond its control.
LTN is not responsible for losses arising from third-party platform outages, internet service provider failures, or force majeure events.
8. Limitation of Liability
To the maximum extent permitted by law:LTN shall not be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits, perceived diminished value, emotional distress, or speculative market loss.LTN’s total liability, if any, shall not exceed the commission actually earned by LTN from the specific transaction giving rise to the claim.
9. IndemnificationClient agrees to indemnify and hold harmless LTN, its contractors, crew members, and affiliates from claims, losses, damages, or expenses arising from:
• Ownership disputes• Authenticity disputes• Undisclosed defects• Legal violations related to submitted items• Unauthorized representation of authority
10. Force Majeure
LTN shall not be liable for delay or failure to perform due to events beyond reasonable control, including but not limited to:
• Natural disasters• Power outages• Internet service failures• Platform disruptions• Government actions• Labor disruptions
11. Governing LawThese Terms shall be governed by the laws of the State of California, without regard to conflict of law principles.Any dispute shall be resolved in the appropriate courts located within California.
12. ModificationsLTN reserves the right to update these Terms. Continued engagement of services constitutes acceptance of updated Terms.
